MAGA hardliner Rep. Andy Biggs (R-AZ) criticized Judge James Boasberg during a widely circulated segment on Fox News, accusing him of breaching the Good Behavior Clause of the U.S. Constitution and expressing his desire to dismiss the contentious judge.
To provide context, Boasberg challenged President Trump’s authority by preventing the president from utilizing the Alien Enemies Act to deport members of the Tren de Aragua gang to Venezuela. This unprecedented action faced significant backlash from conservatives, prompting Republican lawmakers to advocate for limitations on activist judges.
In the segment aired on April 1, 2025, Biggs began by discussing Article Three of the Constitution. He stated, “We arrive at the point where Article Three, section one permits only a federal district judge, or any judge, to serve under a term of good behavior. The phrase ‘during good behavior’ is the exact wording from the Constitution.” He elaborated on how Boasberg may have breached this constitutional requirement. Biggs remarked, “When you misuse your authority to undermine what the President is lawfully executing under various statutory and constitutional provisions, you are the one failing to act in good behavior, and in my view, you should be removed from office, which is why I have introduced a bill addressing this issue.”
Reiterating his stance against the judge, the resolute Republican emphasized his argument. He stated, “A judge like Boasberg must be held accountable; this is not an impeachment, as impeachment necessitates specific allegations under Article Two, section four. However, Article Three, section one stipulates that one may only serve during a term of good behavior, and I believe he has surpassed that limit and clearly demonstrated that he should be removed.”

In support of his position, he stated, “Article III, Section 1 of the Constitution empowers Congress to create all federal courts that are subordinate to the U.S. Supreme Court, and it stipulates that judges may retain their offices only during periods of good behavior. This clause is distinct from Congress’s power to impeach civil officials for ‘Treason, Bribery, or other high Crimes and Misdemeanors.’”
He then elaborated on how Boasberg targeted the president. The press release noted, “As outlined in the resolution, Judge James Boasberg intentionally and unjustly interfered with President Trump’s execution of foreign policy, targeting him for partisan motives and political advantage. Under the Good Behavior Clause, Boasberg’s conduct amounts to misbehavior, warranting his removal from office.”
In conclusion, Biggs issued a pointed statement to the media. He remarked, “We cannot remain passive while activist judges, who mistakenly believe they possess greater authority than the duly elected President of the United States, impose their political agendas on the American populace.”
Further criticizing the judge, he asserted, “Judge Boasberg has misused his judicial power for political purposes and is in violation of the constitutional Good Behavior Clause. He should not be allowed to continue in his role.
